GENERAL TERMS AND CONDITIONS OF SALE AND USE

ARTICLE 1 – CONCEPT

Glorious Escape is a live escape game concept owned by ADM Action Escape SARL.
These General Terms and Conditions of Sale apply to any contract for the provision of a game room entered into between (1) any company in the ADM Action Escape SARL group and (2) the users of the room, who will subsequently be referred to as “USERS”; whether they have booked personally or are part of the team of the person who made the booking, hereinafter referred to as “THE BUYER”.

These conditions apply regardless of the booking method, whether made via the website (https://www.gloriousescape-stbrice.fr), hereinafter referred to as the “WEBSITE”, or with ADM Action Escape staff.
The game space made available to players is called the “ROOM” and the provision contract is called the “CONTRACT”.
The game session for which the BUYER books and pays on the WEBSITE is called the “GAME SESSION”.

ADM Action Escape SARL reserves the right to modify all or part of these General Terms and Conditions of Sale as well as the content of its WEBSITE (https://www.gloriousescape-stbrice.fr/), at its sole discretion, at any time and without notice.
In the event of a revision of the General Terms and Conditions of Sale, the applicable terms will be those in force at the time of booking by THE BUYER.
The General Terms and Conditions of Sale of ADM Action Escape SARL are available on the WEBSITE and can be consulted freely upon simple request to the reception staff of ADM Action Escape SARL.

ARTICLE 2 – PROVISION AND USE OF THE ROOM

According to the very principle of the game, ADM Action Escape SARL grants USERS the right to occupy the ROOM for a maximum duration of 60 (sixty) minutes.
The purpose of occupying the ROOM is solely to participate in a game organized by ADM Action Escape SARL, which must be played in teams of 2 to 7 people maximum.

USERS accept that the duration of their presence in the ROOM is a maximum of 60 minutes, whether or not they have managed to find all the clues and solve all the puzzles.
This point is part of the very principle of the game. Similarly, USERS accept that the game may end before the 60 minutes are up, particularly if they have managed to find all the clues and solve all the puzzles in less than 60 minutes; without this entitling them to any price adjustment or compensation.

Admission to the ROOM is only possible upon presentation of the booking confirmation email (sent shortly after the payment process to THE BUYER) and upon presentation of an identity document from the latter.
The complexity of the game does not allow USERS under the age of 8 to participate.
Minor USERS under the age of 12 must be accompanied by an adult.
Minor USERS over the age of 12 do not necessarily have to be accompanied by an adult.
In case of doubt about the age of a USER, ADM Action Escape SARL reserves the right to request proof of identity.

USERS are required to keep the ROOM and all its equipment (non-exhaustive list: decorations, furniture, etc.) in good condition and to use it in accordance with the authorized use.
As such, the USER acknowledges in the CONTRACT that any intentional damage or damage caused by unauthorized handling of the room and its equipment will be recharged.
Furthermore, the USER is required to use the ROOM and its equipment in such a way as not to cause or risk causing any damage to other USERS, to the premises and equipment of ADM Action Escape SARL.

Throughout their presence on the premises of ADM Action Escape SARL, the USER undertakes to behave respectfully, to comply with the rules and to cooperate with the staff of ADM Action Escape SARL.
In this regard, ADM Action Escape SARL does not tolerate any form of violence, whether verbal or physical, in the form of harassment or intimidation towards its employees and thus reserves the right to refuse access to the premises to any person whose behavior resembles the elements mentioned above.
ADM Action Escape SARL also reserves the right to refuse access to any person under the influence of alcohol or drugs, as a safety measure for said person and their surroundings.
For all the conditions mentioned above, the access ban does not entitle to any compensation or refund.

Due to the nature of the game, no recording may be made in the ROOM.
Therefore, the use of photo/video and/or audio recording devices (this includes, but is not limited to: mobile phones, cameras, GoPros) is strictly prohibited.
Any use of such a device may result in the complete stoppage of the game for the entire team.
ADM Action Escape SARL expects its USERS not to disclose the details of the game directly and/or indirectly.
Any partial or total disclosure would violate the commercial interests of ADM Action Escape SARL.

ARTICLE 3 – PRICES

The prices charged by ADM Action Escape SARL are indicated on the WEBSITE and are also displayed at the reception of ADM Action Escape SARL’s premises. They are displayed in euros (€) including all taxes (VAT) and per person, for a sixty-minute SESSION.
The price per person is set according to the number of participants in the same team (2 to 7 people maximum).

Any other service will be subject to additional billing. (Catering services, reception room, other drinks…)
ADM Action Escape SARL reserves the right to modify its prices at any time. Any BUYER will pay the amount corresponding to the rate in effect at the time of their booking.

ARTICLE 4 – BOOKING

The provision of a ROOM is subject to booking and payment of either a deposit of 28€ VAT included per booked game room or the full amount of the service.
On the day of the service, you will need to pay the balance before the start of the SESSION.
The booking is made by THE BUYER on the WEBSITE of ADM Action Escape SARL https://www.gloriousescape-stbrice.fr/
All bookings are made from the WEBSITE and according to the availability displayed on it. The booking is firm and final only after receipt of the booking confirmation email, which is sent to THE BUYER at the end of the payment process.

In some exceptional cases, the staff of ADM Action Escape SARL may make the booking on behalf of THE BUYER if the latter cannot make the booking themselves on the WEBSITE. In these specific cases, THE BUYER accepts without any reservation that this type of booking does not entail any liability on the part of ADM Action Escape SARL or its staff, as the staff will only act as data entry operators according to the instructions given by THE BUYER. THE BUYER therefore waives any recourse due to misuse, breach of confidentiality of their data, or fraudulent use of their account.
Only payment by credit card is accepted on the WEBSITE.
ADM Action Escape SARL has entrusted the management of its payment platform to a provider specialized in securing online transactions.
The latter does not retain any payment data concerning THE BUYER in its databases.

In accordance with Article 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities that must be provided on a specific date or during a specific period.
Consequently, no booking can be canceled or refunded.
In the event of natural disasters, health disasters, administrative closures or any other events preventing the opening of the establishment and thus the proper conduct of the booked game session, ADM Action Escape SARL will postpone the booking to a later date that the CUSTOMER can define.
A booking cannot be transferred or resold for commercial purposes.
If a booking is transferred or resold in violation of this article, the holder will be refused access.

In case of a delay of more than 15 (fifteen) minutes by USERS for a booked SESSION, the delay will be deducted from the initial game duration.
In all cases, the ROOM must be vacated at the time specified in the initial booking.
ADM Action Escape SARL reserves the right to refuse access to USERS whose delay amounts to 30 minutes or more.
The schedules will be systematically reminded in the confirmation emails sent by ADM Action Escape SARL.
If fewer USERS show up to participate in the GAME SESSION than initially planned during the booking, THE BUYER/USERS cannot claim a refund for the price difference; however, a credit note in the form of a gift voucher for the difference may be issued to THE BUYER/USERS upon their request, which must be made by email. If more USERS show up to participate in the GAME SESSION than initially planned during the booking, the price difference must be paid before participating in the game, within the limit of 7 players (USERS) authorized per ROOM.
ADM Action Escape SARL reserves the right to refuse any booking from a BUYER who has not paid for all the services that have been invoiced to them.
Gift vouchers do not have an expiration date; they can be used in one go either on the WEBSITE at the time of booking or directly on site.

ARTICLE 5 – RIGHT OF WITHDRAWAL FOR ONLINE BOOKINGS

In accordance with Article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities that must be provided on a specific date or during a specific period.
Consequently, no booking can be canceled or refunded.

ARTICLE 6 – RIGHT OF WITHDRAWAL FOR GIFT VOUCHERS

For gift vouchers, in accordance with Article L. 221-18 of the Consumer Code, in the event of distance selling, THE BUYER has a withdrawal period of 14 days from receipt of the gift voucher by THE BUYER without having to justify reasons or pay penalties.
THE BUYER informs ADM Action Escape SARL of their decision to withdraw by sending an electronic communication to contact@gloriousescape-stbrice.fr, before the expiry of the period provided for in Article L. 221-18, the form available for download here: Withdrawal Form or any other unambiguous statement expressing their wish to withdraw.
Gift vouchers can only be used once.
THE BUYER acknowledges that the right of withdrawal cannot be exercised for any gift voucher that has already been used, in whole or in part.
As no return is necessary for electronic gift vouchers, the refund will take place within 14 days from receipt of the withdrawal request.

ARTICLE 7 – PERSONAL DATA

THE BUYER is responsible for the accuracy of the information entered on the online booking form on the WEBSITE.
THE BUYER agrees to receive information and commercial offers from ADM Action Escape SARL at their email address or on their mobile phone by checking the authorization box on the WEBSITE.
THE BUYER and/or USER who enters their telephone or electronic contact details on the WEBSITE of ADM Action Escape SARL hereby agrees to be contacted by ADM Action Escape SARL by telephone, SMS or email.
ADM Action Escape SARL undertakes not to transmit the personal data of its USERS to a company outside the ADM Action Escape SARL group, except in the event of a request from an authority authorized by law and within the framework of the legal provisions in force.

CNIL declaration: In accordance with Law 78-17 of January 6, 1978 (amended by Law 2004-801 of August 6, 2004 relating to the protection of individuals with regard to the processing of personal data) relating to information technology, files and freedoms, known as the “Informatique et Libertés” Law (www.cnil.fr).
In this regard, the website www.gloriousescape-stbrice.fr certifies that it complies with all the rules imposed by the CNIL.
Databases are protected by the provisions of the law of July 1, 1998 transposing Directive 96/9 of March 11, 1996 on the legal protection of databases.

You have the following rights regarding your personal data:
In accordance with the European Regulation on the protection of personal data UE 2016/679 (GDPR), THE BUYER may exercise their right of access to data concerning them, rectification, erasure, request a limitation of processing, object to it or request its portability by contacting contact@gloriousescape-stbrice.fr
THE BUYER also has the right to lodge a complaint with the CNIL. As consent to the processing of personal data is an obligation under the GDPR, before purchasing a GAME SESSION, THE BUYER agrees to provide their email address and telephone number to ADM Action Escape SARL

ARTICLE 8 – SAFETY

THE USER undertakes to comply with all safety measures given to them, whether contractual, posted on site or given orally by the staff of ADM Action Escape SARL.
Smoking is strictly prohibited inside the premises.
Each USER undertakes to be aware of and comply with the safety and fire protection instructions, as well as the emergency exits. These are clearly identified in the premises of ADM Action Escape SARL.
It is strictly forbidden to obstruct emergency exits, which must remain clear at all times.
THE USER may use the emergency exits if and only if the situation requires evacuation of the premises (e.g., fire).
Any misuse and/or untimely opening of these exits by one or more USER(S) will result in the recharging of the costs incurred by such misuse.

THE USER is aware that it is absolutely forbidden to bring into the premises and the ROOM objects considered as (1) physical dangers (explosive, flammable, oxidizing, pressurized or liquefied gas, corrosive), (2) dangerous to health (toxic, corrosive to the skin, irritant/sensitizing, carcinogenic/teratogenic) and (3) dangerous to the aquatic environment.

ARTICLE 9 – RECOURSE TO MEDIATION

In accordance with Article L. 152-1 of the Consumer Code, you can use the free mediation service of CM2C, which we are affiliated with, electronically at www.cm2c.net or by post at CM2C – 12 rue Saint Jean 75017 Paris for any complaint.
It is recalled that recourse to mediation is only possible provided that your complaint has not been previously examined by a judge or another mediator, and that it has already been the subject of a complaint to our Customer Service. Mediation does not apply to disputes between professionals.

ARTICLE 11 – COMPETENT COURTS

These General Terms and Conditions and any contract entered into incorporating these terms and conditions are governed by French law and all disputes are subject to the exclusive jurisdiction of the French courts.
